Introduction
Pete Fowler, founder of Pete Fowler Construction, got his start working in the wild west of the construction defect litigation industry in the mid-1990s. So, he wrote a magazine article about it. In October of 1998,The Journal of Light Construction published “Common Construction Defects,” the first exploration of construction defects in a national publication (to our knowledge). Fast-forward to now and see the growing niche of lawyers, construction experts, and service providers who pursue, defend, and support the practice of construction defect litigation.
Since the 1990s Pete Fowler Construction has worked on thousands of litigated and non-litigated construction defect projects (claims, litigation, etc.). We have built world-class systems and training around investigating, documenting, understanding, analyzing, repairing, and avoiding construction defects and defect-related claims and litigation. This update is a natural next step in that learning process.
If you are a property owner or manager, developer or contractor, building product manufacturer or supplier, insurer, or lawyer, then this program is for you. You need to understand "the forest" perspective of the actual defects that often lead litigation instead of trying to focus on each “tree.”
We will begin with a review of what the world of construction defects looked like in the 1990s, then dig into today with a review of high-risk building elements and the most common defects in each of those categories. We will conclude with a high-level summary of what it takes to avoid construction defects.
